SALT Report 1811 – The Nevada Department of Taxation issued guidance for businesses that include sales tax in the total sales price. Nevada Law NRS 372.120 provides that tax may be included in the final selling price if the public is properly informed. In order to comply with the law, businesses that sell products that include tax are required to do one of the following:
- Post a sign or notice indicating that the price includes sales tax, or
- Print it on the customer receipt that the price includes sales tax
If you do not properly inform your customers, you may be assessed additional taxes, penalties and interest. Further, NRS 372.115 provides that anyone who advertises the tax will be paid, absorbed, or assumed by the retailer is guilty of a misdemeanor.
