Texas – Proposed Bill to Prohibit the Taxation of Certain Foods and Medicines

SALT Report 1907 – The Texas State Legislature proposed a constitutional amendment that would prohibit the imposition of sale or use tax on certain foods, drinks, medicines, and child-care services.

The text of the Joint Resolution reads as follows:

Article VIII, Texas Constitution, is amended by adding Section 28.

Section 28:  The legislature may not enact a general law that would impose a state tax on the sale or use of:

  • A food or a drink that was not subject to taxation under Chapter 151, Tax Code, on January 1, 2013,
  • A medicine that was not subject to taxation under Chapter 151, Tax Code, on January 1, 2013, or
  • A child-care service that was not subject to taxation under Chapter 151, Tax Code, on January 1, 2013

The proposed amendment will be on the November 5, 2013 ballot.
