New York – Commercial Motor Carriers Must Register Vehicles for Highway Use Tax

SALT Report 2566 – The New York Department of Taxation issued a warning for commercial motor carriers who are required to register their vehicles with the Tax Department for Highway Use Tax. Effective January 1, 2013, every vehicle that is registered to pay Highway Use Tax is required to attach a decal to the front bumper of their vehicle. This requirement applies to all vehicles, other than to trucks transporting automotive fuel, with a gross weight of more than 18,000 pounds.

The new decal requirement also applies to vehicles that are required to have an automotive fuel carrier certificate. This includes any truck, trailer, semitrailer, or other attachment used to transport automotive fuels on New York State highways that weigh more than 18,000 pounds.

Operating a vehicle without the appropriate HUT or AFC decal will result in fines of up to $250 for the first conviction. Any subsequent conviction will result in a fine of up to $500, and may include imprisonment for up to 10 days. The New York State Police Department estimates that citations for failing to register with the Department have averaged 500 per month since February 2013.
