West Virginia – Food Tax Phased Out

SALT Report 2673 – In the final step of a multi-year sales tax phase-out, West Virginia Governor Earl Ray Tomblin announced that as of July 1, 2013 food and food ingredients for human consumption are no longer subject to sales and use taxes.

However, state and local sales and use tax still applies to soft drinks, prepared food, food sold in a heated state, food sold with eating utensils provided by the seller, and food sold through vending machines.
