Colorado — Marketplace Fairness and Small Business Protection Act

SALT Report 3384 –Governor John Hickenlooper recently signed the Marketplace Fairness and Small Business Protection Act, which goes into effect July 1, 2014.  The bill would require any online retailer with nexus in Colorado to collect and remit sales tax on purchases made by Colorado residents.   The following are the types of connections online businesses must have in order to be required to remit sales taxes to the state.

  • Having a physical store, warehouse or distribution facility in the state.
  • Delivering, installing or assembling property in the state.
  • Using advertising media such as television, radio, newspapers, magazines, and the internet in the state.
  • Allowing customers to pick up orders at business locations in the state.
